TERMS AND CONDITIONS OF MARKOFOOD.PL ONLINE STORE

 

§ 1 GENERAL PROVISIONS

  1. By using the markofood.pl online store the User accepts these Terms and Conditions.
  2. The owner of the markofood.pl online store is ZPOW MARKO Komorowscy Spółka Jawna [General Partnership], Nasiegniewo 15, 87-811 Fabianki, Tax Identification Number (NIP): 8883138177.
  3. The markofood.pl online store can only be used by an adult with full legal capacity or consent from a statutory representative to use the markofood online store.
  4. The owner reserves the right to modify the features of the markofood.pl store and to cease its operations. In such a case, the User is not entitled to any claims against the Owner.
  5. The User consents to the processing of personal data for technical, statistical and marketing purposes by the markofood.pl online store team.
  6. The personal data stored at the markofood.pl online store can be profiled and processed for technical, statistical and marketing purposes by the markofood.pl online store team.

§ 2 DEFINED TERMS

  1. Terms and Conditions –  this document specifying the rules for the use and provision of services by the markofood.pl online store.
  2. User – a person who uses the services offered by the markofood.pl online store via the Internet.
  3. User’s account – an individual electronic account registered by the User of markofood.pl online store in the markofood.pl online store  identified by the username and password chosen by the User, which at the same time constitutes an entry to the database of users of the  markofood.pl online store.
  4. Online store team –  persons acting under the authority of the owner of the markofood.pl online store.

§ 3 INFORMATION

  1. Prices in themarkofood.pl online store are displayed in Polish zlotys, are gross amounts and include VAT tax.
  2. The final price of an order is the price for goods and delivery costs.
  3. For domestic shipments over 30 kg the customer should contact the markofood.pl online store to determine the shipping fee.

§ 4 SALE AGREEMENT

  1. The User pays for the purchased goods on the date set during placement of the order in the markofood.pl online store.
  2. The User can choose between the following methods of payment: bank transfer or payment by card or cash on delivery. Detailed information can also be obtained by contacting the markofood.pl online store by phone or email. 

§ 5 RIGHT OF WITHDRAWAL

  1. The User has the right to withdraw from the contract within 14 days without giving any reason.
  2. The period of withdrawal from the contract expires after 14 days from the date on which the User received the goods.
  3. The User must inform the markofood.pl online store about his decision to withdraw from the contract by way of an unambiguous statement, using the data provided in these Terms and Conditions.
  4. To maintain the deadline for withdrawal from the contract, it is sufficient for the User to send information regarding his decision to exercise the right to withdraw from the contract before the deadline of 14 days from the receipt of goods.
  5. In the event of withdrawal from the contract, all payments received from the User, apart from the delivery costs, shall be returned immediately, no later than within 14 days from the day the team of the markofood.pl online store was informed about the User’s decision to withdraw from the contract.
  6. The refund shall be made using the same payment method that was used by the User.
  7. The markofood.pl online store can withhold the refund until receiving the returned goods.
  8. The User should send back the goods no later than on the 14th day from the date on which he informed about his intention to withdraw from the contract. The deadline shall be met if the User sends back the goods within 14 days.
  9. We do not accept collect-on-delivery shipments. The User bears the cost of returning the goods.
  10. The User is obliged to return the goods unchanged, with original labels and without any signs of use. The goods that the User wishes to return should be sent to the addresses listed in § 8.

§ 6 CLAIMS AND WARANTY

  1. The markofood.pl online store is obliged to deliver goods that are free from defects.
  2. In the event the Customer finds the goods defective, he shall contact the team of the markofood.pl online store.
  3. Complaints should be reported in writing or by e-mail to the addresses provided in § 8 of these Terms and Conditions.
  4. The complaint should include a brief description of the defect, date it ocurred, data of the User submitting the complaint and proof of purchase.
  5. Goods returned on the basis of the complaint should be sent to the addresses provided in § 8 of these Terms and Conditions.
  6. We do not accept collect-on-delivery shipments. The User bears the cost of returning the goods.
  7. The goods shall be repaired or replaced or a refund equal to the value of the ordered goods shall be made.

§ 7 PERSONAL DATA

  1. By making a purchase in the markofood.pl online store the User voluntarily provides his data, which are necessary to complete the order.
  2. The User has the right to access and change his personal data.

§ 9 FINAL PROVISIONS

  1. In matters not covered by this document, generally applicable provisions of the Polish law shall apply.
  2. The sales contract concluded on the basis of these Terms and Conditions applies to a specific order and is concluded in order to fulfil this specific order. Each order requires the User to accept these Terms and Conditions separately.
